Terms of Service

This English translation is provided for convenience. If there is any inconsistency between the two versions, the Korean version prevails.

Article 1 (Purpose)

These Terms of Service (the "Terms") set forth the rights, obligations and responsibilities between TokenPost Co., Ltd. (the "Company") and users in connection with the real-time caption interpretation service the Company sells and provides under the name barotalk (the "Service"). The Service is developed and operated by PUBLISH, an affiliate of the Company, while sales in Korea, customer contracts and payments are handled by the Company.

Article 2 (Definitions)

1. "User" means any person who uses the Service under these Terms. 2. "Member" means a person who has signed up for the Service and been issued an account. 3. "Event" means a unit a Member creates within the Service to broadcast captions and interpretation. 4. "Attendee" means a person who views the captions of an Event opened by a Member.

Article 3 (Effect and Amendment of the Terms)

1. These Terms take effect upon being posted on the Service. 2. The Company may amend these Terms to the extent this does not violate applicable law, and will announce the effective date and the reasons for the amendment at least 7 days before the effective date (30 days for changes unfavorable to users). 3. A user who continues to use the Service without expressing refusal by the effective date of the amended Terms is deemed to have agreed to them.

Article 4 (Sign-up and Accounts)

1. Membership is established when an applicant agrees to the Terms, applies through the procedure set by the Company, and the Company accepts the application. 2. Members are responsible for managing their account (including email, password and event operation codes) and must not allow third parties to use it. 3. If an account was created by fraudulent means such as using another person's information, the Company may restrict use or terminate the agreement.

Article 5 (Fees and Payment)

Service fees follow the pricing page, and VAT is charged separately. Payment is made by credit card (via the Kiwoom Pay secure payment window). Live hours are prepaid: charged hours are valid for 6 months from the date of charge, and an additional charge extends the validity of the entire remaining balance. Remaining hours expire once the validity period has passed.

Article 6 (Withdrawal and Refunds)

1. A user may withdraw the purchase and receive a full refund within 7 days of payment if none of the charged hours have been used. 2. Even after 7 days, if no charged hours have been used at all, a refund is available by arrangement with customer support (info@barotalk.kr). 3. Once use of charged hours has begun (live caption broadcasting for an event), refunds are limited under Article 17(2) of the Act on Consumer Protection in Electronic Commerce. This is also indicated on the payment screen. 4. If an event could not proceed normally due to causes attributable to the Company (service failure), the Company will credit back or refund the hours corresponding to the affected use. 5. Refunds are processed to the original payment method within 7 business days of the request.

Article 7 (Nature of AI Interpretation)

1. The Service's captions and interpretation are generated in real time by artificial intelligence, and mistranslations or omissions may occur depending on the speaking environment (noise, pronunciation, technical terminology, etc.). 2. The Company strives to improve accuracy but does not guarantee the completeness or accuracy of translation results, and recommends adding review by a professional interpreter for uses where accuracy is critical, such as legal or medical settings. 3. Caption screens may indicate that the output is AI-generated.

Article 8 (Rights to Content)

1. Rights to the presentations a Member broadcasts at an Event, the materials they upload, and the captions and records generated from them belong to the Member (or the original rights holder). 2. The Company processes such content only within the scope of providing the Service, improving quality and analyzing errors, and does not disclose it externally without the Member's consent. 3. Intellectual property rights in the Service itself (software, trademarks, design) belong to the Company and PUBLISH.

Article 9 (User Obligations)

Users must not do any of the following: broadcast content that infringes the rights of others (copyright, likeness rights, etc.); operate events in violation of applicable law; reverse-engineer, crawl or gain unauthorized access to the Service; share or sell operation codes or accounts without authorization; or interfere with the normal operation of the Service.

Article 10 (Company Obligations)

The Company complies with applicable law and these Terms, and makes commercially reasonable efforts to provide a stable Service. The Company protects users' personal information in accordance with the Privacy Policy.

Article 11 (Changes to and Suspension of the Service)

1. The Company may change or discontinue part or all of the Service when operationally or technically necessary, and will give prior notice in such cases. 2. The Service may be temporarily suspended for scheduled maintenance and similar reasons; if paid use is materially affected, Article 6(4) applies mutatis mutandis.

Article 12 (Restriction of Use and Termination)

1. If a user violates Article 9, the Company may restrict use of the Service or terminate the agreement after prior notice; in urgent cases it may act first and notify afterward. 2. A Member may terminate the agreement at any time by deleting their account, and refunds of remaining charged hours follow Article 6.

Article 13 (Limitation of Liability)

1. The Company is not liable for service interruptions caused by events beyond its control, such as natural disasters or failures of telecommunications carriers or cloud providers. 2. Absent willful misconduct or gross negligence, the Company's liability is limited to the fees the user paid for the affected event.

Article 14 (Governing Law and Dispute Resolution)

Disputes related to these Terms are governed by the laws of the Republic of Korea, and the court with jurisdiction over the location of the Company's head office is the competent court.
